Terms of Service

1. Acceptance of Terms

By accessing or using MightyKey.ai (“the Service”), operated by Mighty Maverick LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MightyKey.ai is an autonomous, agentic Business Operating System that uses AI agents to build, deploy, and manage business systems on behalf of users. The Service includes a web portal, API access, agent execution capabilities, and related tools.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials, including passkeys and API keys. You must notify us immediately of any unauthorized access.

4. Billing and Credits

The Service offers subscription plans and prepaid credit purchases. All credit purchases include a service margin. Credits are non-refundable except as required by law or at our discretion. We will never charge for system failures. Pricing is subject to change with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Generate malicious software, phishing content, or spam
• Attempt to bypass safety controls or approval workflows
• Access other users' data or accounts
• Use the Service for any illegal or harmful purpose
• Reverse-engineer the Service or its AI models

6. Agent Execution

AI agents may take actions on your behalf, including creating code, deploying services, and making API calls. You retain responsibility for reviewing and approving agent actions. The progressive autonomy model requires your explicit consent before agents operate independently.

7. Data Ownership

You retain ownership of all content and data you provide to the Service. We retain ownership of the Service, its algorithms, and aggregate analytics. Agent-generated code and artifacts belong to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by third-party providers, force majeure, or circumstances beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGHTY MAVERICK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your access will be revoked and your data will be available for export for 30 days, after which it may be deleted.

12. Changes to Terms

We may update these Terms. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
